By accessing or using Kimox VPN services, including our website, applications, APIs, and related tools (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Services. We may update these Terms from time to time, and your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
2. Description of Services
Kimox VPN provides encrypted mesh networking software that enables secure connectivity between devices, servers, and cloud resources. The Services include client applications, administrative consoles, APIs, documentation, and support channels as described on our website.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time. We will make reasonable efforts to notify you of material changes that affect your use of the Services.
3. Accounts and Registration
You must create an account to use certain features of the Services. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, or impair the Services. Prohibited activities include, but are not limited to: distributing malware, conducting unauthorized network scanning, circumventing access controls, or using the Services to transmit illegal content.
You are solely responsible for configuring your mesh network, access control policies, and connected resources. Kimox provides the connectivity layer; you retain responsibility for the security and compliance of your workloads and data.
5. Fees and Payment
Certain tiers of the Services require payment of fees as described on our pricing page. Fees are billed in advance on a monthly or annual basis, depending on your selected plan. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
We may change our fees upon thirty days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.
6. Intellectual Property
Kimox and its licensors retain all rights, title, and interest in the Services, including all software, documentation, trademarks, and related intellectual property. These Terms do not grant you any rights to our intellectual property except the limited license to use the Services as described herein.
Open-source components included in the Services are governed by their respective licenses, which are available in our documentation and source repositories.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Kimox shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to Kimox for the Services during the twelve months preceding the claim.
8. Termination
Either party may terminate these Terms at any time. You may cancel your account through the admin console or by contacting support. We may suspend or terminate your access if you violate these Terms or if required by law.
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — will remain in effect.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
